02. HOW TO REGISTER

It is necessary to register to access our services, the user must register by filling out the registration form where personal information will be requested that must be updated and adjusted to reality. At the end of the registration, the user must accept these GENERAL BOOKING CONDITIONS and our PRIVACY POLICY.

04. RESERVATIONS THROUGH OUR WEBSITE

To make any travel reservation or the rest of the services offered by Viatges VilaNova, you must select a valid payment method, authorizing us to make charges using said selected payment method.

Any operation will be subject to the User reading and accepting these General Booking Conditions. Once the same as well as the contracting conditions applicable to the reservation and purchase of the selected product have been accepted and the corresponding payment has been made, we will complete the operation as soon as possible.

In the event that due to certain circumstances we could not complete the orders placed, we will notify you as soon as possible.

05. PRICES AND METHODS OF PAYMENT

All prices offered on our website are represented in EUROS (EUR). 

Payments and reimbursements of all operations will be made in euros (EUR). If your credit/debit card is not denominated in EUROS, the exchange rate will be applied by the corresponding bank according to the market exchange rate and may vary with respect to the price indicated on our website.

In the case of contracting combined trips, the price of the combined trip has been calculated based on currency exchange rates, transport rates, the cost of fuel or other energy sources, rates, taxes and other tourist surcharges including those of landing, embarkation and disembarkation in ports and airports if they are expressly included as applicable on the date of delivery of the pre-contractual information.

Unless otherwise indicated, the offer program reflects prices per person with accommodation in a standard double room and economy class flights.

Any variation in the price of the aforementioned elements may lead to the revision of the final price of the trip, both upwards and downwards, in the strict amounts of the aforementioned price variations. These modifications will be notified in writing to the traveler.

In no case will the price of the trip be revised upwards in the 20 days immediately prior to the departure date. If the price increase exceeds eight percent of the price of the combined trip, the traveler may terminate the contract by notifying the organizer.

The means of payment through which you can buy on the website are: Virtual POS through the REDSYS payment gateway.

REDSYS is a certified payment gateway with a high security standard in means of payment, the bank card data entered during the purchase process will be encrypted and stored securely.

The bank cards accepted on the Viatges VilaNova website are the following: Visa and Mastercard.

Viatges VilaNova will always use insurance payment methods. Viatges VilaNova will not keep in its files the information regarding the data of the cards used. When using the debit/credit card, the user confirms that the card used is his or has been duly authorized by its owner for its use. Credit/debit card transactions will be subject to security control and validation by the issuing entity. In the event that the card issuer denies the transaction, Viatges VilaNova will not be responsible for the delays or cancellations of the operations. When the contribution of funds is made by credit or debit card, the expenses or commissions that the entity providing the payment service would have charged Viatges VilaNova will be the exclusive account of the client.

06. ORDER CONFIRMATION

Orders are subject to acceptance by Viatges VilaNova, to the user complying with and accepting the GENERAL RESERVATION CONDITIONS and to market availability. Viatges VilaNova reserves the right not to accept the order in the event that the payment information is not approved, or that any other type of incident related to the General Conditions of Use of the portal is detected. When you carry out a transaction through our website we can send you a confirmation email that will contain details of the transaction. Please verify that the details in the confirmation message are correct as soon as possible and keep a copy for your records.

07. RIGHT OF WITHDRAWAL

The transactions carried out on our website include: trips, activities and tourist services that are contracted directly with different providers and tour operators. All of them enjoy the right of withdrawal in the terms and conditions of return that for each product the service provider establishes in the combined travel contract or in the purchase of autonomous services in each case and of which you will be aware before accepting the pay.

08. OUR RIGHT TO MODIFY THESE CONDITIONS

Viatges VilaNova may review and modify these Conditions at any time.

You will be subject to the policies and Conditions in force at the time you use this website or carry out each operation, except that by law or decision of government agencies we must make retroactive changes in said policies, Conditions or PRIVACY POLICIES, in in which case, the possible changes will also affect the orders that you had previously made.

09. PROTECTION OF PERSONAL DATA

10. EXEMPTION OF LIABILITY

We will not be responsible for any breach or delay in the fulfillment of any of the assumed obligations, when it is due to events that are beyond our reasonable control ("Cause of Force Majeure"). Causes of Force Majeure will include any act, event, lack of exercise, omission or accident that is beyond our reasonable control and, among others, the following:

(i) Strikes, lockouts or other protest measures.

(ii) Civil commotion, riot, invasion, terrorist threat or attack, war (declared or not) Threat or preparations for war.

(iii) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.

(iv) Impossibility of using trains, ships, planes, motor transport or other means of transport, public or private.

(v) Impossibility of using public or private telecommunications systems.

(vi) Acts, decrees, legislation, regulations or restrictions of any government or public authority.

It will be understood that the obligations will be suspended during the period in which the Cause of Force Majeure continues, and we will have an extension in the term to fulfill said obligations for a period of time equal to the duration of the Cause of Force Majeure. We will use all reasonable means to end the Force Majeure Event or to find a solution that allows us to fulfill our obligations despite the Force Majeure Event.

11. INTEGRITY

These Conditions and any document to which express reference is made in them constitute the entire existing agreement between you and us in relation to the purpose of the same and replace any other agreement, agreement or previous promise agreed between you and us verbally or written.

You and we acknowledge having consented to the execution of a contract without having relied on any statement or promise made by the other party or that could be inferred from any statement or writing in the negotiations entered into by the two before it, except for what is expressly mentioned in these Conditions.

Neither you nor we will have any recourse against any untrue statement made by the other party, verbal or written, prior to the date of a contract (unless such untrue statement was fraudulently made) and the only recourse available to you is the other party will be for breach of contract in accordance with the provisions of these Conditions.

If any of these Conditions or any provision of a contract were declared null and void by a final resolution issued by a competent authority, the remaining terms and conditions will remain in force, without being affected by said declaration of nullity.

12. JURISDICTION AND APPLICABLE LAW

The sale is understood to be made in Andorran territory. The Terms and Conditions are governed by Andorran law. Users of this website submit to Andorran jurisdiction, expressly waiving any other jurisdiction that, according to Law, may correspond to them.
